Terms and Conditions
Legal framework for our logistics services
Last updated: April 1, 2025. Please read these terms carefully before using our logistics services.
General Terms
These Terms and Conditions govern your use of Lomarline's logistics and transportation services. By engaging our services, you agree to be bound by these terms. If you disagree with any part of these terms, please refrain from using our services.
Service Agreement
Lomarline agrees to provide logistics, transportation, and warehousing services as specified in the service contract. All services are subject to availability and operational capacity. We reserve the right to refuse service if the requested transportation violates any laws or regulations.
Rates and Payment
Rates for our services are established based on service type, distance, cargo weight, volume, and handling requirements. Payment terms are specified in your service agreement. Late payments may result in additional fees and service suspension.
Cargo Responsibility
The customer is responsible for properly packaging all cargo to withstand normal transportation handling. Lomarline assumes responsibility for cargo from the time of pickup to delivery as specified in the contract, subject to the limitations outlined in these terms.
Liability Limitations
Lomarline's liability is limited to the declared value of the cargo or the maximum amount specified by applicable transportation laws, whichever is lower. We are not liable for any consequential, indirect, or special damages, including lost profits.
Claims Procedure
Any claims for loss or damage must be submitted in writing within 7 days of delivery or expected delivery date. Claims must include documentation of the cargo's value and evidence of damage or loss. Failure to file a timely claim may result in claim denial.
Force Majeure
Lomarline is not liable for delays or service failures resulting from circumstances beyond our reasonable control, including natural disasters, severe weather, labor disputes, civil unrest, government actions, or unforeseen transportation network disruptions.
Insurance
We recommend that customers obtain appropriate cargo insurance for all shipments. Lomarline can facilitate additional insurance coverage at the customer's request and expense, which must be arranged prior to shipment.
Confidentiality
Both parties agree to maintain the confidentiality of all business information, including pricing, routes, cargo details, and contractual terms. This obligation survives the termination of our service relationship.
Governing Law
These Terms and Conditions are governed by the laws of Romania. Any disputes arising from or related to our services shall be resolved through arbitration in Romania, unless otherwise specified in your service contract.
Term Modifications
Lomarline reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website or direct notification to customers. Continued use of our services after changes constitutes acceptance of the revised terms.
